PEOPLE WITH PETS OUTREACH PROJECT FOSTER AGREEMENT
I agree to abide by the following rules and conditions whenever fostering any animal for People with Pets Outreach Project (herein known as PWPOP):
- I understand that I am responsible for adhering to all PWPOP standards of care and applicable local and state laws dealing with animal welfare. If I am charged with violating any local or state ordinance or statute while in possession of the pet I understand that PWPOP is not responsible for obtaining legal counsel for me or paying any fines or penalties assessed.
- I understand that the pet is the property of PWPOP. As a Foster Home I do not have any ownership of the pet; all such rights remain fully and forever with PWPOP.
- Foster Home is not authorized to make any legal or medical decisions on behalf of the pet.
- Foster pet shall not be sold, given to, placed in the care of, offered or delivered for adoption to another person, organization or any other entity including, but not limited to, a family member, friend, rescue facility, research facility or shelter.
- Pet must be returned to PWPOP if, for any reason, Foster Home can no longer care for the pet or at the request of PWPOP. PWPOP will need a reasonable amount of time to re-home or retrieve the pet.
- Violation of this agreement will result in travel costs, court costs and attorney fees payable by the Foster Home if legal action or travel is necessary for PWPOP to recover the pet.
- Foster Home understands that the pet has intrinsic value and is not replaceable. Therefore, if the pet is lost, euthanized or otherwise unable to be returned to PWPOP due to the negligence of the Foster Home or intent to circumvent PWPOP’s ownership or possession of the pet it is agreed that the Foster Home will be in breach of this agreement and is subject to pay liquidated damages to PWPOP in the amount of $2,500.00
- I understand that the name of the pet may not, under any circumstances, be changed. The name listed in this agreement is necessary for record keeping, appointments, public information, etc. and I agree that the pet will be called by the name listed in this agreement at all times.
- I understand that the pet will be fostered as a family companion animal only. The animal will not be kept outside under any circumstances.
- Foster dogs and puppies will NEVER have any unsupervised off-leash time. Foster Home will provide a kennel, crate and/or securely fenced yard for their safety. (A fenced yard is not required, but is encouraged.)
- Foster dogs and puppies will NEVER be kept chained or tied up, continuously in a yard, garage, patio, balcony or pen, or outdoors, even in a fenced yard, when no one is at home.
- Foster dogs and puppies will be walked on a leash and exercised in a fenced yard. They may be crated for no longer than eight (8) hours at a time. The crate MUST be large enough for the dog to stand up, turn around and lay comfortably on their side.
- A leash, collar, ID tag or crate may be provided by PWPOP if needed and if available.
- Foster dogs and puppies may not be taken to dog parks or play groups until or unless they are spayed/neutered and approved by PWPOP.
- Foster dogs and puppies will never be subject to the use of any choke-type collars, prong collars, or shock collars at any time.
- Foster cats and kittens will NEVER go outside except to transport them to and from PWPOP or to a veterinarian, if needed. Transport will be done in a sturdy and secure carrier and in an enclosed vehicle only.
- Foster pet will be treated as a family member with loving care and affection. Foster Home will do their best to ensure the pet’s safety and well-being.
- Pet will not be isolated from the Foster Home household.
- I understand that if the pet becomes lost I will immediately notify PWPOP. I will also notify PWPOP immediately of any change to my personal contact information (name, address, phone, email).
- I agree that, when requested, I will provide a progress report and update to PWPOP and convey any concerns that may have arisen.
- I will provide adequate care of the pet including feeding, watering and exercising. I agree to provide an appropriate and nutritious diet, including any supplements, as recommended and provided to you by PWPOP.
- Foster Home will abide by any instructions given by PWPOP regarding the feeding of specific brands or types of food, nutritional supplements, and/or treats.
- PWPOP will make every attempt to furnish food and/or litter for those Foster Homes who are unable to afford these supplies on their own, it is understood that the availability of these supplies is based on donations from the public and limited to stock on hand and Foster Home will be responsible for providing these necessary supplies in the event they are not available through PWPOP.
- PWPOP cannot and does not guarantee to be able to provide free food, litter or other supplies for any pet.
- Foster Home agrees to provide pet with all required medications or treatments as needed and prescribed by the veterinarian utilized by PWPOP.
- Foster Home is not authorized to seek outside veterinary care for any PWPOP pet without prior approval. If Foster chooses to treat the pet at a veterinarian of their choice it is understood that Foster Home will assume full responsibility for payment of the vet care bill and that PWPOP will be unable to reimburse for any such payment.
- I understand that PWPOP will take every precaution to ensure that any pet is reasonably healthy and that any known health or medical problems will be disclosed prior to the pet entering the Foster Home, but PWPOP cannot be held responsible for any unforeseen health problem that may develop after the pet is in the care of the Foster Home.
- I understand that PWPOP may require me to return the pet to their care to assess or treat any health problem at their discretion.
- If the pet becomes ill or injured as a result of the Foster Home’s unreasonable conduct or negligence, PWPOP will be entitled to any and all expenses incurred to return the pet to health.
- I understand that PWPOP cannot and does not make any representations or warranties, either expressed or implied, concerning the temperament, habits, health, pedigree, disposition, age, sex or background of any pet and that I have no right to a reimbursement of medical or other professional fees. Additionally, I understand that the pet’s future reactions to me, my family and any other person are completely unpredictable because animals, like people, have their own personalities.
- I am taking possession of the pet at my own risk and I release PWPOP, its officers, directors, members, employees, representatives, agents and assigns from any and all liability arising out of possession of the pet.
- I agree to provide adequate, positive socialization for any pet fostered by me to help ensure their temperament is as sound as possible.
- I acknowledge that PWPOP may not be held liable should the pet bite or injure another animal or person while in my possession. I accept full liability for the pet while in my care, recognizing the potential issues that may arise with any animal.
- PWPOP will not place any pet known to be of unsound temperament. However, no one can predict how any pet will react in a given situation. Therefore, it is strongly urged to exercise prudence and caution when introducing the pet to a new situation (other homes, meeting other animals) until the pet has become fully adjusted to its new environment and the Foster Home has had an opportunity to become familiar with the pet’s unique personality. Foster Home accepts all responsibility and liability for all introductions.
- Foster Home assumes all responsibility for any events that occur in connection with fostering a pet for PWPOP.
- Foster Home agrees to be responsible for anyone handling the animal fostered by them doing so in a safe and hygienic manner. Foster Home will not hold PWPOP responsible for any injuries that may result from their failure to do so.
- Foster Home will notify a PWPOP representative IMMEDIATELY of any bites that break that skin that occur to any person or animal while the pet is in their care.
- PWPOP will not be responsible for any bodily injuries or property damage and/or injury or damage to other animals caused by the foster pet or actions of the Foster Home. The Foster Home hereby specifically assumes sole responsibility for, and agrees to indemnify and hold People with Pets Outreach Project harmless from, any and all loss and expenses (including legal fees) by reason of liability imposed by law upon PWPOP or any of its officers, directors, members, employees, representatives, agents or assigns because of bodily injuries or death to any person or persons including those in the Foster Home household, or any damage to property and/or animals arising out of or in consequence of the placement of the pet howsoever such injuries, death or damage to property and/or animals may be caused, whether or not the same may been caused, or may have alleged to have been accused, by negligence of the aforementioned parties or any of their officers, directors, members, employees, representatives, agents or assigns or any other person.
- I understand that PWPOP will not be held liable for any damage or loss resulting from the failure of the foster pet to respond to any commands taught to them or resulting from counseling advice applied to the foster pet. In the event that any behavioral concerns arise, the Foster Home will immediately notify PWPOP.
- Should any behavior of the foster pet result in damage to property, Foster Home, Foster Home Household members, or another person or animal while in possession of the Foster Home the Foster Home agrees to assume full liability to such third party for any and all such damage, and to absolve PWPOP from any and all obligations to pay such damage to third party.
- Foster Home understands that the possibility of their family members or other people being bitten, scratched or contracting diseases does exist.
- Foster Home understands that the possibility of foster animals fighting, injuring or spreading illness to their own pets does exist and agrees to keep foster pet separate from their own pets.
- Foster Home understands that if they choose to allow foster pets to interact with their own pets that they are doing so own their own risk and will not hold PWPOP liable for any illness or injury that may occur to their pets.
- Foster Home agrees to keep their own pets up to date on vaccines and de-wormers per the instruction from their own veterinarian while fostering any pets for PWPOP.
- Foster Home agrees to not mix any foster animals or animals from more than one litter unless approved by PWPOP.
- Foster Home agrees to not foster animals from any other organization while fostering for PWPOP, unless granted specific approval to do so.
- I affirm that no member of my household has been convicted or charged with any animal welfare law violation such as neglect, cruelty, abandonment, etc. I further affirm that no member of my household has been convicted or charged with any domestic battery or sex crime.
- I understand that by voluntarily signing this agreement I am entering into a legal and binding contract with PWPOP. I understand that any misrepresentations in this agreement are cause for PWPOP to declare this agreement in breach.
- I agree that a PWPOP representative has reviewed documented information about this pet with me. I am fostering with awareness of any documented medical or behavioral history. I understand that fostering is a large responsibility, but also largely rewarding. I am aware that I can reach out to PWPOP at any time with any questions or concerns. I understand that a representative can be expected to respond within a 12-hour timeframe if not immediately reached.
